Second Offense OWI Dismissed After Assistant D.A. Causes Mistrial

Man charged with second offense OWI.  At the jury trial, the assitant district attorney caused a mistrial by violating a court order on a motion in limine.  Attorney Griessmeyer argued the case should be dismissed based on double jeopardy when the prosecutor tried to retry the man.  The judge denied the motion.  Attorney Griessmeyer argued suppression based on 4th amendment issues brought up during the first trial.  The case was dismissed after the defense motion was granted.
