2nd Offense OWI Case Dismissed After D.A. Caused Mistrial

Man was charged with second offense OWI.  At the jury trial, the assistant d.a. violated a court's order on a motion in limine.  Attorney Griessmeyer argued double jeopardy when the prosecutor tried to re-try the man.  The trial judge denied the motion.  Attorney Griessmeyer argued supression based on 4th amendment issues which came out during the first trial.  The judge granted the motion and the case was dismissed.
